New York Judge Permits A Lawsuit On Meta And TikTok Over Teen's Death While Subway Surfing

Meta is slowly becoming the hotspot for lawsuits and the platforms have invited another one unknowingly. In a recent development, a wrongful death lawsuit has been filed against Meta Platforms and ByteDance. The lawsuit came into action after the mother of the deceased 15-year-old boy moved to court against the tech giant. According to a report by Reuters, the boy lost his life while subway surfing on a moving train and the move was influenced by the content on the mentioned platforms. Meta And TikTok’s Trouble Has Just Begun Justice Pauk Goetz, A New York state judge, ruled on Friday that Norma Nazario, mother of the deceased, can try to prove that both Meta and ByteDance ‘goaded’ her son Zackery into subway surfing by getting him addicted to platforms like TikTok and Instagram. Zackery viewed the content related to dangerous challenges on the platform and that became the reason for his demise. As for the incident, Zackery Nazario passed away on February 20, 2023, when he has his girlfriend climbed on top of a Brooklyn going J train as it crossed the Williamsburg bridge. As mentioned by the mother, a low beam struck Zackery which caused him to fall between subway cars. His mother claimed that she found multiple videos based on subway surfing on Zackery’s social media handles. Both ByteDance and Meta have described Zackery’s death as a heartbreaking incident. On one hand, Meta and ByteDance are seeking immunity from the scenario under Section 230 of the federal Communications Decency Act and the free speech clause of the First Amendment of the US Constitution. Still, Justice Goetz’s decision has increased the trouble of the two companies involved here. The road ahead in this case for both Meta and ByteDance looks like a bumpy one for sure.
